1. About these terms
These terms govern your use of MotorLoop (the “Platform”), an online marketplace operated by MotorLoop Pty Ltd (ABN [ABN]) that connects buyers and sellers of vehicles in Australia. By creating an account, listing a vehicle, or enquiring about a listing, you agree to these terms. You must be at least 18 years old and able to form a binding contract to use the Platform. Our Privacy Policy explains how we handle personal information.
2. Our role — marketplace only
MotorLoop is a venue. We are not a motor dealer, broker, auctioneer, or party to any sale. The contract of sale for a vehicle is between the buyer and the seller. We do not own, inspect, hold, or transfer title to any vehicle listed on the Platform, and we do not guarantee the accuracy of listings, the condition of vehicles, or the completion of any transaction.
3. Accounts
You must provide accurate information when registering and keep your credentials secure. You are responsible for activity under your account. If you enquire about or list a vehicle without an account, we create a basic account from the details you provide so the seller can respond and you can claim it later — our Privacy Policy explains this. We may suspend or close accounts that breach these terms or the law.
4. Seller obligations
Sellers must:
- be legally entitled to sell the vehicle listed;
- describe the vehicle accurately, including odometer reading, condition, damage history, and any encumbrance (money owing);
- comply with all laws applying to the sale, including the Australian Consumer Law and any state or territory requirements such as roadworthy / safety certificates, transfer of registration, and licensed-dealer obligations where applicable;
- not list stolen, written-off (unless lawfully disclosed as repairable write-off), or encumbered vehicles without disclosure.
By publishing a listing you confirm its contents are accurate, and you remain responsible for them — including any parts drafted with the Platform’s AI tools. If you sell vehicles in trade or commerce (e.g. you are a dealer), additional obligations apply, including statutory warranties in some states. In Victoria, buying, selling, or exchanging 4 or more vehicles in any 12-month period may deem you a motor car trader requiring an LMCT licence. You are responsible for meeting these obligations.
5. Buyer responsibilities
Buyers should conduct their own due diligence before purchasing, including a PPSR (Personal Property Securities Register) check for encumbrances and written-off/stolen status, an independent inspection, and verification of registration and the seller’s identity. Private sales generally do not carry statutory warranties.
6. Acceptable use
You must not:
- post false, misleading, or deceptive content (misleading or deceptive conduct is prohibited under the Australian Consumer Law);
- use the Platform for spam, scraping, fraud, or payment scams;
- harass other users or post unlawful or infringing content;
- interfere with the operation or security of the Platform.
7. Fees
Listing a vehicle is currently free. We plan to introduce a success fee — currently advertised at $50 including GST, payable only if your vehicle sells, and waived for your first six months. No fee will ever apply without being displayed to you before you commit to it. Fee changes apply prospectively, with notice. Fees are non-refundable except as required by law (including the Australian Consumer Law).
8. AI tools
Parts of the Platform use artificial intelligence — for example drafting a listing from your photos and details, suggesting a price, or interpreting a search. AI outputs are machine-generated and are not manually reviewed; they may be inaccurate or incomplete, and you should verify them independently before relying on them. If you use AI tools to help create a listing, you remain responsible for the listing’s accuracy and its compliance with these terms.
9. Content, licence & moderation
You retain ownership of content you post (photos, descriptions). You grant us a non-exclusive, royalty-free licence to host, display, and promote that content on and in connection with the Platform, including a right to sublicense to service providers who help us operate it. We may edit listing metadata, and may remove or unpublish any listing or content at our discretion, including where it breaches these terms or the law.
10. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability can be limited, it is limited (at our option) to resupplying the relevant service or paying the cost of having it resupplied.
11. Liability
To the extent permitted by law, we are not liable for loss arising from dealings between buyers and sellers, the condition or legality of any vehicle, content posted by users, or interruption or unavailability of the Platform.
12. Indemnity
You indemnify us against liability, loss, and reasonable costs arising from a third-party claim connected to content you post, your use of the Platform, or your breach of these terms or the law — reduced to the extent we caused or contributed to the loss. Nothing in this clause limits your rights under the Australian Consumer Law.
13. Dispute resolution & complaints
If you have a complaint, contact us first at [email protected] — we aim to acknowledge complaints promptly and to work with you in good faith to resolve them within 30 days. Nothing in these terms prevents you from complaining to Consumer Affairs Victoria or another regulator, or limits any right you have to apply to a court or tribunal.
14. Termination
You may close your account at any time. We may suspend or terminate access for breach of these terms, unlawful conduct, or where required by law.
15. Changes
We may update these terms from time to time. Material changes will be notified on the Platform or by email. Continued use after a change takes effect constitutes acceptance.
16. General
If part of these terms is found invalid, the rest still applies. We may assign these terms as part of a corporate restructure or a sale of the Platform; you may not assign them without our consent. These terms, together with the Privacy Policy, are the entire agreement between you and us about the Platform.
17. Governing law & contact
These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts. Questions: [email protected].
